Terms & Conditions

Lasting Impressions (Driveways, Landscaping & Tree Surgery)

These Terms and Conditions govern all work carried out by Lasting Impressions (“we”, “us”, “our”) for the client (“you”, “the customer”). By accepting a quotation, booking services, or allowing work to commence, you agree to be bound by these Terms and Conditions.

1. Quotations and Pricing

  • All quotations are valid for 30 days unless otherwise stated.
  • Quotations are based on the information available at the time of inspection or discussion.
  • Any unforeseen work, ground conditions, hidden obstructions, or customer-requested changes may result in additional charges.
  • Prices include labour and materials unless stated otherwise.
  • VAT (if applicable) will be shown on the quotation or invoice.

2. Acceptance of Work

  • Acceptance of a quotation may be verbal, written, electronic, or implied by allowing work to commence.
  • Once accepted, cancellation may result in charges for:
  • Work already completed
  • Materials ordered or delivered
  • Labour and associated costs

3. Payment Terms

  • Payment terms will be clearly stated on the quotation or invoice.
  • Unless otherwise agreed in writing, payment is due on completion of the work.
  • Late payments may incur:
  • Statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 (where applicable)
  • Reasonable recovery or administration costs
  • We reserve the right to suspend or withhold work where payment terms are not met.

4. Site Access and Preparation

  • You must provide clear, safe, and adequate access to the work area for vehicles, machinery, and staff.
  • You are responsible for removing vehicles, personal items, pets, and obstacles from the working area before work begins.
  • We are not liable for damage to items left within the working area.

5. Ground Conditions and Underground Services

  • We are not responsible for delays, damage, or additional costs caused by unforeseen ground conditions, including poor ground, drainage issues, or hidden obstructions.
  • It is your responsibility to inform us of any known underground services, including:
  • Gas, water, electricity
  • Drainage, sewage
  • Internet, phone, or data cables
  • We accept no liability for damage to unmarked or unknown services.

6. Weather Conditions

  • Landscaping, driveway, and tree work are weather-dependent.
  • We are not responsible for delays or cosmetic imperfections caused by adverse weather.
  • Certain materials (including concrete, tarmac, resin, and turf) require suitable weather conditions to perform correctly.

7. Variations and Additional Work

  • Any changes requested after work has commenced may result in additional charges.
  • Where possible, variations will be agreed before the work is carried out.

8. Completion Dates

  • Any start or completion dates provided are estimates only.
  • We are not liable for delays caused by weather, material availability, unforeseen circumstances, or third parties.

9. Maintenance and Aftercare

  • Newly installed driveways, paving, turf, and landscaping may require settling, curing, or ongoing maintenance.
  • We are not responsible for damage caused by:
  • Misuse or lack of maintenance
  • Heavy vehicles
  • Natural ground movement or subsidence
  • Hairline cracks, colour variation, and minor movement are considered normal and do not constitute defects.

10. Waste and Disposal

  • Unless otherwise agreed, waste generated by our work will be removed from site.
  • Any hazardous, contaminated, or pre-existing waste discovered remains the responsibility of the customer.

11. Tree Surgery – Specific Terms

Lasting Impressions (Driveways, Landscaping & Tree Surgery)

  • All tree work is carried out to industry standards and with reasonable care and skill.
  • You confirm you have authority to instruct tree work on the property.
  • We are not responsible for:
  • Root movement, subsidence, or ground changes following tree removal or pruning
  • Regrowth, seasonal changes, or natural tree behaviour
  • It is the customer’s responsibility to inform us of:
  • Tree Preservation Orders (TPOs)
  • Conservation Area restrictions
  • Boundary ownership issues
  • We accept no liability for delays or penalties resulting from undisclosed restrictions.

12. Liability

  • All work is carried out with reasonable care and skill, in accordance with the Consumer Rights Act 2015
  • Our liability is limited to the value of the work carried out
  • We are not liable for indirect or consequential losses, including loss of use or enjoyment
  • Nothing in these Terms limits liability for death or personal injury caused by negligence

13. Guarantees

  • Any guarantees offered relate to workmanship only, unless stated otherwise
  • Natural movement, weathering, and material variation are not covered
  • Guarantees are void if work is altered, repaired, or maintained by third parties without our written consent

14. Damage to Property

  • Due to the nature of groundwork and tree work, minor disturbance or damage may occur
  • We are not responsible for:
  • Pre-existing defects
  • Weak or unstable structures
  • Damage to walls, fences, paving, or services not disclosed prior to work

15. Ownership of Materials

  • All materials remain the property of Lasting Impressions until full payment has been received

16. Termination

  • We reserve the right to terminate or suspend work if:
  • Payment terms are breached
  • Unsafe working conditions arise
  • The customer breaches these Terms

17. Governing Law

  • These Terms and Conditions are governed by the laws of England and Wales
  • Any disputes shall be subject to the jurisdiction of the English courts
